Understanding North Carolina’s Personal Injury Laws

If you’ve been injured in an accident caused by someone else’s negligence, it’s important to understand how North Carolina’s personal injury laws may affect your claim. These laws include the contributory negligence rule, the statute of limitations, and other legal principles that can significantly impact your ability to recover compensation.

Contributory Negligence Rule

North Carolina is one of the few states that follows the doctrine of contributory negligence, which is one of the strictest fault-based laws in the country. Under this rule, if you, the injured party, are found to be even 1% at fault for the accident that caused your injuries, you may be completely barred from recovering any compensation.

For example, if you were involved in a car accident where the other driver was speeding, but you were also distracted by your phone at the time of the crash, the other party’s legal team may argue that your distraction contributed to the accident.
