A correction officer at Rikers Island snapped a photo of a nasty wound, which resulted from a random attack in the visitors’ center and shared it on Facebook with the caption of "The Things That Happens On The Island Shhh".
The injured man has now filed a lawsuit against the officer, the Department of Correction, and the city of New York for causing him "further distress and humiliation" by making him relive the incident. The assault that left the man with an eight-inch cut on his right cheek, which required 90 stitches to close.
Can prison guards take photos and share them? Do you have a right to privacy while visiting an inmate? The law is clear; there is no expectation of privacy when visiting an inmate. Generally, you can take and publish photos taken in any public place where people have no reasonable expectation of privacy.
