Charges have been brought against the son of a former Assembly speaker and three other men in the fatal stabbing that happened near San Diego State University.
Fred and Kathy Santos state in their lawsuit that Rafael Garcia, Ryan Jett, Esteban Nunez and Leshanor Thomas are civilly responsible for the death of their son, Luis, who was 22 at the time of the stabbing. He was a student at San Diego Mesa College.
The four men involved have already pleaded guilty in criminal court to various charges. However, Jett, who prosecutors say is responsible for inflicting the fatal wound, as well as Nunez, were given sixteen years each in prison. Nunez became lucky when the former Governor Arnold Schwarzenegger, before he left office on Dec. 31, commuted his sentence to seven years, as he was believed to be less culpable in the stabbing as Jett.
The Santos' filed the wrongful death suit on Sept. 30 in San Diego Superior Court. They have instructed their attorneys to wait until now, however, to reveal the circumstances of their lawsuit to the public.
